1a. Website Terms
These Terms and Conditions govern your use of the Convert77™ website and related website features operated by ASTON H-S Ltd, company number 15866638, trading as Convert77™ ("Convert77", "we", "us" or "our").
Convert77™ is a trading name of ASTON H-S Ltd. Our registered office is ASTON H-S Ltd 124 City Road, London, EC1V 2NX, United Kingdom.
By using the website, you agree to comply with these Terms. If you do not agree with them, you should not use the website.
1b. Related Policies and Service Terms
These Terms should be read together with the Privacy Policy, Cookie Policy, any proposal, quotation, statement of work, service agreement, payment terms or other contractual document that applies to a specific service.
Where separate contractual documentation applies to a Convert77 service, that documentation will govern that service to the extent stated in the relevant document.
The Business Growth Audit™ is also subject to the specific scope, pricing, delivery and purchase information presented on the Business Growth Audit™ pageand at checkout.
Participation in the Partner Programme is subject to the separate Partner Programme Terms.
2. Website Information and Business Outcomes
We aim to keep website information useful, clear and reasonably accurate at the time it is published. We do not guarantee that every page will always be complete, current or suitable for every business or circumstance.
Examples, opinions, service descriptions, testimonials, reviews, metrics and case-study information are provided for context and should not be interpreted as a guarantee of future performance.
Convert77 does not guarantee that use of the website, our services, recommendations or materials will produce a particular level of revenue, sales, enquiries, traffic, ranking, conversion rate, profitability, return on investment or any other specific commercial outcome.
Business performance depends on factors outside our control, including market conditions, pricing, competition, implementation decisions, customer behaviour, platform changes, search-engine changes and the client's own business operations.
3. No Professional Advice
Website content, audits, observations, reports and recommendations do not constitute legal, financial, accounting, tax, regulatory, cybersecurity, medical or other specialist professional advice unless expressly stated otherwise.
You are responsible for obtaining appropriate specialist advice where required before acting on information or recommendations.
4. Intellectual Property
Unless otherwise stated, website content including text, graphics, branding, layouts, designs, images, illustrations, videos, documents, downloadable resources, concepts and other materials is owned by or licensed to ASTON H-S Ltd.
You may view and use website content for lawful personal or internal business purposes. You must not reproduce, redistribute, republish, sell, commercially exploit or materially modify our content without prior written permission except where permitted by law.
Convert77 retains ownership of its reusable methodologies, processes, systems, templates, frameworks, know-how and other pre-existing or reusable materials unless a written agreement expressly says otherwise.
5. Acceptable Use
You must not use the website:
- For unlawful, fraudulent or malicious purposes.
- To gain or attempt unauthorised access to systems or data.
- To interfere with the website's operation or security.
- To introduce malicious code or harmful material.
- To scrape, reproduce or commercially exploit website content without permission where such use is not permitted by law.
- In a way that infringes third-party rights or materially harms Convert77's legitimate interests.
6. Third-Party Links and Services
The website may link to or load third-party services including Cal.com and Stripe. Those providers operate independently and their own terms, privacy information and service conditions may apply.
Convert77 is not responsible for the availability, content, security, performance or practices of a third-party service except to the extent responsibility cannot lawfully be excluded.
7. Limitation of Liability
Nothing in these Terms excludes or limits liability where it would be unlawful to do so, including liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, or any other liability that cannot legally be excluded or limited.
Subject to that statement and to any separate written agreement, and to the maximum extent permitted by law, Convert77 and ASTON H-S Ltd will not be liable for indirect or consequential loss arising solely from use of the public website or reliance on general website content.
For business users, this may include loss of anticipated profit, revenue, opportunity, savings, goodwill or business performance where the law permits such exclusion and no separate contract provides otherwise.
Where you purchase a service, any contractual liability terms in the relevant proposal, statement of work, purchase terms or service agreement take precedence where stated.
8. Testimonials, Reviews and Case Studies
Testimonials, reviews, ratings and case-study metrics may reflect the experience of individual clients. Individual results vary and past results are not guarantees of future results.
Convert77 aims to distinguish genuine commissioned client work from concepts, exploratory work and demonstrations.
9. Concept, Exploratory and Demonstration Work
Some visual work may be conceptual, exploratory, speculative or created for demonstration rather than commissioned by the business or brand shown.
Where work is identified as conceptual or non-client work, it must not be interpreted as evidence that Convert77 has provided services to the named business or organisation.
Third-party trademarks, names, logos and other intellectual property remain the property of their respective owners.
10. Enquiries, Project Forms and Bookings
Submitting a project enquiry, booking a call, completing a form or contacting Convert77 does not by itself create a contract or guarantee that Convert77 will accept or undertake the requested work.
We may use the information you provide to respond, assess suitability, clarify requirements, prepare a proposal or agree an appropriate next step.
You are responsible for providing information that is accurate and sufficiently complete for the purpose for which it is supplied.
11. Client Services
Service descriptions and starting prices shown on the website are provided for general commercial guidance and do not by themselves constitute a binding offer to deliver a specific scope.
Unless expressly stated otherwise, a project is subject to the scope, price, timetable, payment terms and contractual documentation agreed for that project.
Convert77 may decline a project or service request, including work that it reasonably considers unlawful, harmful, misleading, exploitative, unsuitable or inconsistent with its business standards.
11a. Business Growth Audit™
The Business Growth Audit™ is a one-off paid commercial website review intended to identify potential weaknesses, opportunities, priorities and practical next steps relating to a business's current digital presence.
The current advertised price is £99. Unless otherwise stated at purchase, normal delivery is within 1-2 working days after successful payment and receipt of the information reasonably required to perform the review.
The Audit may cover first impression, messaging and positioning, customer journey, trust, credibility, conversion friction and prioritised opportunities. The exact assessment depends on the website and information reasonably available at the time.
The Audit is a professional assessment, not a guarantee that every issue, risk or opportunity will be identified, and it does not guarantee increased traffic, enquiries, sales, rankings, conversion rate, revenue or profitability.
Recommendations are not automatically implemented. Any redesign, development, copywriting, SEO, optimisation or other implementation service must be agreed separately unless expressly included.
Purchasing an Audit does not oblige you to buy further services from Convert77.
Where the website states that the £99 Audit fee will be credited against an eligible Convert77 website project started within 30 days, that credit applies only to eligible projects accepted by Convert77 and is applied against the agreed project price. It is not a cash rebate.
Cancellation and refund rights, including any mandatory consumer rights that apply, are not excluded by these Terms. Where the law requires an express request or acknowledgement before a service begins during a statutory cancellation period, Convert77 will seek the required confirmation before relying on it.
11b. Service Information and Scope Changes
Service descriptions, starting prices, estimates, availability and indicative timeframes may change. Website prices described as estimated or starting costs are illustrative before any additional agreed scope, third-party software, licences, subscriptions or other pass-through costs. The applicable scope, final price and timetable are the ones confirmed at purchase or in the relevant written agreement.
Where an instalment option is shown or made available through a third-party payment provider, availability is subject to that provider's terms, eligibility checks and approval. Convert77 does not guarantee that a provider will offer or approve instalments and is not the lender unless expressly stated otherwise.
If agreed scope changes materially after a project begins, Convert77 may require a revised quote, timetable or written variation before carrying out the additional work.
11c. Partner Programme
Partner Programme applications and referrals do not create employment, agency, franchise or authority to bind Convert77.
Referral eligibility, attribution, commission, payment timing, exclusions and partner obligations are governed by the Partner Programme Terms applicable to the relationship.
12. Artificial Intelligence and Automated Tools
Convert77 may use artificial intelligence or automated tools internally for research, analysis, content development, design, development, coding or operational work where appropriate.
AI-assisted outputs can contain errors or omissions. Convert77 may review, refine or validate such outputs where appropriate but does not guarantee that every AI-assisted output will be error-free.
Client information used in connection with services will be handled in accordance with applicable privacy obligations and relevant service terms.
13. Website Availability
We aim to keep the website available and functioning properly, but we do not guarantee uninterrupted, error-free or continuously available access.
Features may be unavailable because of maintenance, deployment, internet connectivity, provider outages, security incidents or other circumstances outside our reasonable control.
14. Indemnity for Unlawful Use
To the extent permitted by law, a business user may be responsible for reasonable losses or claims caused by its unlawful misuse of the website, infringement of third-party rights or material breach of these Terms.
This provision does not apply to the extent a loss results from Convert77's own unlawful conduct, negligence or other liability that cannot lawfully be excluded.
15. Force Majeure
Convert77 will not be responsible for delay or failure caused by circumstances beyond its reasonable control, subject to any rights that cannot lawfully be excluded.
Such circumstances may include significant technical failures, third-party platform outages, cyber incidents, natural disasters, extreme weather, industrial action, government action, war, civil unrest or public-health emergencies.
16. Severability
If a provision is found unlawful, invalid or unenforceable, it will be interpreted or adjusted to the minimum extent necessary where possible. The remaining provisions will continue to apply.
17. Changes to These Terms
Convert77 may update these Terms to reflect changes to the website, services, business practices or legal requirements. The current version will be published on this page with its update date.
Changes to these public Website Terms do not retrospectively change a separate contract already entered into unless the law requires it or the parties agree otherwise.
18. Governing Law and Jurisdiction
These Terms are governed by the laws of England and Wales.
Subject to mandatory consumer rights and other applicable requirements, the courts of England and Wales will have jurisdiction over disputes arising from or connected with these Terms and use of the website.
